As Article 107 (1) of the Treaty on the Functioning of the European Union does not provide a specific definition of state aid, the following criteria must be considered when deciding whether aid can be deemed to be state aid:
- aid is granted from state, city, or rural municipality funds;
- aid measure is selective in nature, i.e., it is targeted at a specific undertaking, group of undertakings, or to produce certain goods;
- aid measure confers an advantage to the beneficiary;
- aid measure distorts or threatens to distort competition and trade between European Union Member States.

State aid and de minimis aid may be granted in various forms such as grants, soft loans, guarantees, capital injections, tax exemptions, etc.
Chapter 6 of the Competition Act sets out the national rules for the procedure for granting state aid.
To grant state aid, the grantor must submit a state aid notification to the European Commission in accordance with the provisions of the Competition Act. State aid can only be granted after the positive decision of the European Commission (except de minimis aid and State aid granted on the basis of European Commission's block exemption regulations).
Interesting facts
In 2024, ministries, foundations, agencies, local governments provided a total of 410.5 million euros in state aid and de minimis aid. The total amount of aid decreased by 27.9 million euros, or 6.3%, compared to 2023.
The largest share (83%) of the total amount of aid, or 340.7 million euros, was state aid. The share of state aid in GDP was 0.86%. The total amount of de minimis aid in all sectors amounted to 69.7 million euros, decreasing by 3 million euros, or 4.1%, over the year.
In 2024, the largest aid grantors were Elering AS (19.9% of the total amount of aid), the Ministry of Culture (19.2%) and the Entrepreneurship and Innovation Foundation (19.0%).
As of 1 January 2009, the Register of State Aid and De Minimis Aid, maintained by the Ministry of Finance, keeps track of State aid (excluding State aid in agriculture) and de minimis aid.

State aid issues are coordinated and advice on general issues is given by the State Ownership Policy and Public Procurement Department of the Ministry of Finance. The Ministry of Regional Affairs and Agriculture is dealing with aid related to agriculture, forestry, and fisheries. The Ministry of Climate or the Ministry of Regional Affairs and Agriculture are responsible for the procedure for aid granted to the transport sector.
Institutions granting State aid or de minimis aid are, for example, the State Support Services Centre, Foundation Environmental Investment Centre, Estonian Business and Innovation Agency, Estonian Unemployment Insurance Fund etc.

Estonian regional aid map
The Estonian regional aid map for 2022-2027 (amended on 03.10.2024 in connection with STEP* projects) consists of those regions of a Member State where granting of regional aid (state aid for regional development) is allowed according to the Guidelines on regional aid (2022-2027), and the maximum aid intensity of regional aid (according to the size) of undertakings.
According to the Estonian regional aid map, the entire territory of Estonia is eligible, the aid intensity of large enterprises varies from 20% to 25% of the eligible costs depending on the location of the project. These aid intensities may be increased by up to 20 percentage points for small enterprises or by up to 10 percentage points for medium-sized enterprises. An additional 5 percentage points can be added to STEP* (European Strategic Technologies Platform) projects.
Any aid co-financed by the EU Structural Funds that qualifies as regional aid must also be based on the aid intensities set out in the regional aid map.
